Penalties for Aggravated Assault


Aggravated assault does not require intent to injure, only the intent to cause the victim to believe and fear a sudden attack with the deadly weapon in your possession. A deadly weapon is anything inherently dangerous such as a firearm, knife, baseball bat, or other objects.

Depending on certain aspects of the case, aggravated assault can be classified as a third or second degree felony. A third degree felony can result in up to 5 years in jail, a fine of up to $5,000, upwards of 5 years of probation, and restitution.

Aggravated assault can be upgraded to a second degree felony if the victim is a:

  • Firefighter or police officer
  • Emergency medical care provider
  • Licensed security officer
  • Person over 65 years of age
  • Sports official

A second degree felony carries enhanced penalties of up to 15 years in prison, a fine of up to $10,000, 15 years of probation, and restitution.
