PARENTING PLANS (CHILD CUSTODY)

ST. AUGUSTINE CHILD CUSTODY / PARENTING PLAN ATTORNEYS

Prior to 2008, Florida law provided for one party to be the custodial parent or primary residential parent of minor children who were the subject of a dissolution action. This led to the traditional “custody” fights we associate with contested divorces. However, effective October 1, 2008, the terms “custody” or “primary residence” were removed from the Florida statutes. Instead, the rights and obligations of both parents are now governed by a “parenting plan” including a “time-sharing schedule” for the parents.

Establishing a Parenting Plan can be one of the most emotional issues in family law. If you anticipate a dispute with the other parent over who the child will live with a majority of the time, either in a divorce or paternity proceeding, the necessity of retaining an experienced attorney cannot be overstated. In reality, what in this world is more important that the safety and wellbeing of your child? If your answer to the preceding question is “nothing”, the Albaugh Law Firm is here to help.

There are now twenty factors the court considers when “establishing or modifying parental responsibility and creating, developing, approving or modifying a parenting plan, including a new time-sharing schedule.” As a client, we will apply the facts of your case to those factors and fight to establish the best possible parenting plan for your children.
