You may feel hopeless in this situation, but there is actually much that we can do to defend you against these charges. The crime of battery is a serious offense that often results from heated arguments, fights, or as an act of defense. Battery involves physical contact rather than just threat, such as punching, shoving, or throwing objects. Battery comes in a variety of forms, including:

  • Simple battery
  • Aggravated battery
  • Felony battery

Forms of Battery

Simple battery is the most basic form of this crime but can still result in serious penalties. It occurs when an individual actually and intentionally strikes another person against his or her will. It can also be charged when the alleged perpetrator intentionally causes bodily harm to another person. This crime is charged as a first-degree misdemeanor and can be punished with up to one year in jail.

Felony battery takes place when an individual actually and intentionally strikes another person against his or her will and causes great bodily harm, permanent disability, or permanent disfigurement. It can also occur when a person with a criminal record of misdemeanor battery is accused of committing a second offense of that kind. You can face a charge of a third-degree felony and, if convicted, face a penalty of up to five years in state prison.

If you are charged with aggravated battery, it will be classified as a second-degree felony and be punished by up to 15 years in state prison. Aggravated battery is charged when an individual commits battery and intentionally or knowingly causes great bodily harm, permanent disability, or permanent disfigurement to another person. It can also be charged when the perpetrator uses a deadly weapon while committing the offense of battery. If the victim is pregnant at the time of the battery offense and the alleged perpetrator knew or should have known, then aggravated battery can be charged against the batterer.
